User Terms

OUR PLATFORM AND SERVICES CONTAIN GENERAL MEDICAL INFORMATION. THE INFORMATION IS NOT MEDICAL ADVICE, AND SHOULD NOT BE TREATED AS SUCH. ALL INFORMATION CONTAINED ON OUR PLATFORM IS INTENDED FOR YOUR GENERAL INFORMATION AND EDUCATIONAL PURPOSES ONLY AND IS NOT INTENDED TO BE, AND SHOULD NOT BE USED AS, A SUBSTITUTE FOR ADVICE PROVIDED BY A DOCTOR OR OTHER QUALIFIED HEALTHCARE PROFESSIONAL.

These User Terms are important so please read them carefully. They apply to your activities on this website at www.iamYiam.com (the “Website”) and on the iamYiam mobile application (the “ App”) (the Website and the App are together referred to as the "Platform") and form the basis of the contract between us and you.

You should only use the Platform if you agree with these User Terms. When you click to accept these User Terms, you will be legally bound by them. We recommend that you print or download a copy of these User Terms for your records.

Part 1 will always apply when you use the Platform but the other Parts of these User Terms only apply to certain features of the Platform, such as ordering our DNA Test Service, or booking appointments with Practitioners.

PART 1 – General

  1. Who we are, what we do and contacting us

    1. We are iamYiam Limited, company number 09670819 and with registered address: C43, 5 New Union Square, Ambassador Building - Embassy Gardens, SW11 7BQ, London, UK ("iamYiam", “we”, “ us” and “our” in these User Terms).
    2. iamYiam provides an online preventive health Platform where you can create an account which allows you to access the following services (collectively referred to in these User Terms as the “Services”):

      1. order our DNA Test Service (which is described in more detail on the Platform) and other related or similar services that we may make available through the Platform;

      2. find and book appointments at specific times (“ Appointments”) with our range of specialist practitioners (" Practitioners")

      3. find and order from our range of dietary supplements (“Supplements”)

      4. prompts relating to preventive health suggestions by “SYD”, our artificial intelligence engine, that learns from users’ interactions with the Platform to suggest pathways to meet your preventive health goals; and

      5. carry out your own searches for and locate various alternative preventive health interventions.

    3. You may create an account if you purchase any of our Services using the Platform or are provided with a membership token by iamYiam, one of our institutional clients or distributors of our Services.

    4. If you have any questions about anything in these User Terms, about our Services, or if you wish to discuss something further or make a complaint, then please contact us here . If you have any technical issues with the Platform, please contact us here .

    5. These User Terms refer to the following additional terms, which also apply to your use of our Platform:

      1. Our Privacy Policy ; and

      2. Our Cookie Policy .

    6. We may change these User Terms (or any part of them) from time to time so please check these User Terms each time you use the Platform to ensure you understand the terms that will apply to your use of the Platform or purchase of any Services at that time. We will also notify you of any significant changes either through the Platform or by email. Changes will become effective from the next time that you access your account.



  1. User accounts

    1. You must register an account with iamYiam to use the Services available through the Platform (your " Account"). You will need to pay to register your Account by making payment for our Services via the Platform or by submitting a membership token provided to you by iamYiam, one of our institutional clients or one of our distributors.

    2. If you access our Services and/or the Platform from outside the UK, you should check if it is lawful to do so in your country. We provide our Services and Platform in compliance with laws and regulations applicable to us as a service provider in the UK and cannot take responsibility for any differences between those laws and regulations and any laws and regulations that apply in your location.

    3. If you are a resident of the UK, you must be at least 13 (thirteen) years old to register an Account. If you are not a resident of the UK, please check the data privacy regulations in your country to make sure you are eligible to give consent to the processing of your personal data.

    4. You agree to keep your information accurate, complete and current. You must ensure that your username and password are kept secure and confidential, and must not disclose them to any third party. You are responsible for all activity on your Account. You are solely responsible for monitoring and controlling access to, and use of, your Account.

    5. You may make copies of your information contained in your Account in any format for your own, non-commercial purposes, and you may also make copies of reasonable portions of the Platform and the material and content of the Platform to the extent necessary to make copies of such information contained in your Account. You should think carefully before sharing information about your health with anyone else and we do not recommend sharing information about your health on social media platforms.

    6. You may leave feedback about any of the Practitioners through our Platform. You must make sure that any feedback you provide is an honest and truthful account of your experience with the relevant Practitioner. You must not leave any feedback or comments on, or submit any material to, the Platform that is misleading, untrue, offensive or discriminatory.

  2. Your rights and restrictions

    1. The Platform is provided to you solely for your own personal, non-commercial use.
    2. When using the Platform and your Account, you agree not to:

      1. attempt to undermine the security or integrity of the Platform, iamYiam's computing systems or networks or, where the Services are hosted by a third party, that third party's computing systems and networks. iamYiam will report any security breach to the relevant law enforcement authorities and will co-operate with those authorities, which may include disclosing your identity to them;

      2. use, or misuse, the Services in any way which may damage, disable, overburden, impair or compromise our systems or the functionality of the Services or Platform, or other systems used to deliver the Services or interfere with any other user of the Services or Platform;

      3. attempt to gain unauthorised access to any materials other than those to which you have been given express permission to access or to the computer system on which the Services or Platform are hosted;

      4. transmit, or input into the Services or Platform, any files or data that may damage any other person's computing devices or software, content that may be offensive, defamatory, or otherwise objectionable, or material or data in violation of any law (including data or other material protected by copyright or trade secrets which you do not have the right to use);

      5. create links to the Platform unless iamYiam gives you prior written consent;

      6. attempt to modify, copy, adapt, reproduce, disassemble, decompile or reverse engineer any computer programs used to deliver the Services or to operate the Platform except as is strictly necessary to use the relevant Service or the Platform (as applicable) for normal operation and other than as permitted by law;

      7. impersonate any other person while using the Services or the Platform;

      8. conduct yourself in a vulgar, offensive, harassing or objectionable manner while using the Services or the Platform;

      9. infringe our intellectual property rights or those of any third party in relation to your use of the Services or the Platform, including any material you submit;

      10. not collect or harvest any information or data from any Services, the Platform or our systems or attempt to decipher any transmissions to or from the servers running any of the Services or Platform; or

      11. use the Platform for any unlawful purpose or in any manner inconsistent with these Usage Terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses, or harmful data, into the Platform or any operating system.

    3. If you use any communication tools available through the Platform (such as any forum, chat room or message centre), you agree only to use such communication tools for your personal, non-commercial purposes and in accordance with all applicable laws and regulations. You must not use any such communication tool for posting or disseminating any material unrelated to the Platform or for advertising, marketing or other commercial purposes.

    4. Any information you give to us or a Practitioner, or enter into the Platform must be accurate and in English

    5. When you make any communication on the Platform, you confirm that you are permitted to make such communication. All communications must be conducted in a courteous manner. iamYiam is under no obligation to monitor communications on the Platform or to make sure that they are legitimate, accurate or related only to the use of the Services.

    6. You can terminate these User Terms at any time by asking us to delete your Account by contacting us here and providing the information outlined in Part 9 below. If you do so, you will no longer be able to access your Account or the information held in your Account and your data will be deleted.

    7. You may have other mandatory statutory rights that are granted to you by law, and these User Terms will not affect these rights.

  3. Your data

    1. iamYiam takes its responsibility for care of your personal data very seriously. Please see our Privacy Notice for information on how iamYiam processes your personal data.

    2. iamYiam may use generic, anonymised, aggregated information about you or your use of the Platform and Services and from any analysis that you receive from the DNA Test Service; we will never use any information in a way that identifies you individually. iamYiam may use this information in order to improve its Services and the Platform, research into new products and services and analyse to provide insights our suppliers to enable them to improve their services. We may also use aggregated data to provide insights to our institutional members and to support wider health research.

  4. Accessing our services AND THE PLATFORM

    1. Our Services are accessed remotely using the internet, data networks and devices which can access the internet (“ Infrastructure”) and operate the Platform. We make the Platform available for individuals to access using their Infrastructure, we are not responsible for Infrastructure. If you wish to use the Services or the Platform, you should ensure you have an internet-enabled device and you are responsible for any network connections or telecommunications links needed to use the Services and/or the Platform (as applicable).

    2. Technical or security threats or issues affecting Infrastructure may require us to suspend the Services or the provision of the Platform in order to ensure they are secure and/or operating optimally. We will try to minimise any period of suspension, but the Services and the Platform are provided on an “as-is” and “as-available” bases and we will not be responsible for providing any refunds or compensation if the Services or Platform are not available.

    3. When you use the App or send e-mails and other communications using the internet to us, you are communicating with us electronically. We will communicate with you by e-mail or by posting notices, alerts, prompts, information fields or other information through the App as is necessary to deliver the Services to you.

    4. We operate anti-virus and malicious software prevention measures on the Platform, but cannot guarantee that our Services or the Platform will always be virus-free. You should ensure that all devices you use to access the Services or the Platform are protected against viruses and malicious software. You must not use or expose the Platform (or any part of the Platform) to any viruses or malicious software.

    5. You must not attempt to gain unauthorised access to the Services or the Platform. Installation of the App on a device that has had its operating system compromised by the process of Jailbreaking (Apple iOS) or Rooting (Android) is not permitted and may result in the security of your device or personal data being compromised.

  5. DISCLAIMERS

    1. iamYiam does not provide a healthcare service or give specific medical advice or give or recommend medical treatments or make medical diagnoses.

    2. The Platform and the Services (including the DNA Test Service), contain general medical information about genetics, medical conditions and illnesses, symptoms, diagnosis, therapies and treatments. This information is not advice and should not be treated as such. All information contained on our Platform or provided through our Services including all text and image-based content and online discussions are provided for general information and education purposes only and is not intended to be, and should not be used as a substitute for advice provided by a doctor or other qualified healthcare professional.

    3. If you have any specific questions or concerns about any medical matter before you use our Platform or Services you should consult your doctor or other qualified healthcare professional. You should never delay seeking medical advice, disregard medical advice or discontinue medical treatment as a result of information provided in connection with our Platform or Services.

    4. You are solely responsible for any actions or decisions that you might take or decide not to take after using our Platform or Services. This includes our online discussion functionality. We, and all of our users, contributors or suppliers, will not be responsible for such acts or any decisions you take after using any part of our Platform or Services.

    5. Other than as set out in these User Terms and other than for warranties that cannot be excluded or limited under applicable law, the Platform is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Platform or the Services or any information, content, materials or products included or referenced on the Platform.

    6. iamYiam does its best to ensure that the information accessed through the Platform is accurate and up to date but we cannot guarantee the accuracy or completeness of the information available on our Platform and we may update this information at any time.

    7. iamYiam aims to make the Platform and Services available to you all the time but sometimes it may be unavailable due to maintenance or to factors outside of our control, such as issues with internet connection or networks, unavailability of practitioners due to illness, a force majeure or act of god

    8. iamYiam follows industry standards and processes to prevent against the introduction of viruses, malware and malicious attacks that may harm the Platform or the device that you use to access the Platform, but we cannot guarantee that the Platform will be totally free from viruses and malware.

    9. iamYiam does not guarantee that the Platform will be compatible with all hardware and software that you may use.

    10. The Platform may contain links to third party web sites, applications or programs that are not provided or controlled by iamYiam. iamYiam is not responsible for the content, terms and conditions, offers or privacy policies of such sites and programs. Your dealings with third party sites are solely between you and the applicable third party and you should read their terms and conditions and policies before using them.

    11. Nothing in this disclaimer will limit or exclude our liability for death or personal injury resulting from our negligence or exclude or limit any of other liability that may not be excluded or limited under applicable law.

  6. iamYiam's rights and obligations

    1. iamYiam may:

      1. change, modify, amend or remove some or all of the functionality or content on the Platform at any time; or

      2. may suspend access to your Account or terminate your Account at any time and for any reason. If your Account is terminated then all your data will be deleted.

    2. iamYiam reserves the right to remove any communication or any material held within the Platform at any time in its sole discretion.

    3. You agree that iamYiam is free to use any feedback, comments, information or ideas contained in any communication you send to us for any purpose whatsoever and without providing any compensation, acknowledgement or payment to you, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving the Platform, Services or other products or services.

    4. iamYiam and/or our licensors are the owners of the Platform and all intellectual property in the Platform, which includes (but without limitation) any software, applications and domains made available through it.

    5. All intellectual property rights in the Platform, and the content (except any personal data about you and other users contained in your Account and/or their accounts), video, audio, graphics, logos, icons and service names which appear on the Platform belong, or are licensed, to us or our Practitioners. You do not have any rights to such intellectual property except as expressly set out in these User Terms.

    6. These User Terms do not exclude or limit our liability (or that of a Practitioner where iamYiam acts as agent for the Practitioner) (if any) for:

      1. death or personal injury caused by iamYiam's (or a Practitioner's) negligence;

      2. fraud;

      3. fraudulent misrepresentation; or

      4. any matter which it would be illegal for us to exclude or attempt to exclude our liability.

    7. iamYiam excludes all liability for indirect and consequential losses and damages, and iamYiam (for itself and for the Practitioner where iamYiam acts as agent for the Practitioner) may only be liable to you to the extent you suffer losses as a direct result of its breach of these User Terms, provided that such losses are a reasonably foreseeable result of it breaching these User Terms or its failing to use reasonable care and skill. For the purposes of this section, loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you accepted these User Terms, both we and you knew it might happen. iamYiam (for itself and for the Practitioner where iamYiam acts as agent for the Practitioner) is not liable for any other losses or for business losses (including but not limited to loss of profits, contracts, goodwill or opportunity).

    8. You will have a direct contract with any Practitioners from whom you receive Services. iamYiam is not responsible for the performance or non-performance by any of the Practitioners and is not liable to you for their failures or for any effects or consequences of the services (including the Services) that you receive or do not receive from them.

PART 2 iamYiam App

  1. Using our App

    1. The App includes software provided by organisations other than iamYiam, and uses certain data that you provide to it to allow it to work.

    2. The ways in which you can use the App may also be controlled by your app store's rules and policies and your app store's rules and policies will apply instead of these terms where there are differences between these User Terms and the app store terms.

    3. The App is designed to operates on iPhone version 4S or higher running iOS 10 or higher, or Android-enabled phones running Android v4.4 or higher only. It requires a consistent 4G or faster data connection and does not operate reliably on 3G, GPRS or EDGE connections.

    4. We recommend that if you are using a wireless network to access the App, you avoid use of public wi-fi facilities in favour of a personal wi-fi connection, and that the wireless network is secured with WPA-2 security.

    5. We recommend that the device from which you access the App is password protected and set to lock after a short period of inactivity.

    6. From time to time, updates to the App may be made available to you. Updates may be provided to increase security measures, provide enhanced features or to fix bugs and therefore, we recommend you use the latest version of the App at all times. Depending on the update, you may not be able to use the App or the Services until you have downloaded or streamed the latest version of the App and accepted any new User Terms. Your device may automatically download and install the latest versions of the app unbeknown to you as we release them.

    7. These User Terms provide you, with a personal right to use the App and the Services in accordance with these User Terms. You may not transfer the App or the Services to someone else, except as set out in these User Terms. If you sell or transfer any device on which the App is installed, you must remove the App from it.

    8. If you download or stream the App onto any device that is not owned by you, you must have the owner's permission before doing so. You will be responsible for complying with these User Terms, whether or not you own the device.

    9. By using the App or any of the Services, you agree to us collecting and using technical information about the devices you use the App on and related software, hardware and peripherals to improve our products and to provide any Services to you. To the extent this includes any personal data, we will also process such personal data in accordance with the Privacy Notice .

Restrictions

    1. You agree that you will:

      1. not, except in the course of any sharing expressly permitted under these User Terms, rent, lease, sub-license, loan, provide, or otherwise make available the App or the Services in any form, in whole or in part to any person without prior written consent from us;

      2. not copy the App or Services, except as part of the normal use of the App or where it is necessary for the purpose of back-up or operational security;

      3. not translate, merge, adapt, vary, alter or modify, the whole or any part of the App or Services nor permit the App or the Services or any part of them to be combined with, or become incorporated in, any other programs, except as necessary to use the App and the Services on devices as permitted by, and in accordance with, these User Terms;

      4. not disassemble, de-compile, reverse engineer or create derivative works based on the whole or any part of the App or the Services nor attempt to do any such things. Information necessary to achieve interoperability by virtue of sections 50B and 296A of the Copyright, Designs and Patents Act 1988 will be made available on request; and

      5. comply with all applicable technology control or export laws and regulations that apply to the technology used or supported by the App or any Service.

    2. We recommend that you back up any content and data used in connection with the App, to protect yourself in case of problems with the App or the Services.

    3. The App and the Services have not been developed to meet your individual requirements. Please check that the facilities and functions of the App and the Services (as described on the app store site and on our Website) meet your requirements.

PART 3 Ordering our Services

This Part applies to any Services you purchase from us, for which iamYiam is responsible for providing (for example, the DNA Test Service). Please note that this Part does not apply to any Appointments you make with Practitioners (see Part 4) or any Supplements you order (see Part 5).

  1. DNA Test Service

    1. If you order our DNA Test Service (as further described on our Platform) ("DNA Test Service"), this Clause will apply.

    2. The analysis you receive from the DNA Test Service provides information on your body's pre-dispositions to be affected by, and capability to deal with, a range of genetic risk factors based on your DNA. It matches patterns and trends in your DNA with patterns and trends observed generally in humans in published scientific research covering health, nutrients, fitness, diet and other genetic risk factors. The analysis is derived using an Illumina GSA bead chip which analyses 820,000 genetic variations to produce your results. This analysis does not take into account all factors which may influence how your body responds and reacts to your environment, food, the medicines you take, exercise, stress, etc. so is not conclusive.

    3. The DNA Test Service and the analysis that you will receive (including any action plans or suggested steps) are not intended as medical advice or as a means of diagnosing or predicting any illness or condition or providing any treatment, but are for information, interest and research only. The disclaimers set out in Clause 6 will apply to the DNA Service and any analysis you receive.

    4. iamYiam uses reputable third party experts (“ DNA Testers”) to carry out a DNA Test Service on the sample(s) which you supply. The DNA Testers will carry out the DNA Test Service using reasonable skill and care and in accordance with their professional standards. However, DNA test is still a developing technique and new information and interpretations are being discovered all the time.

    5. Neither iamYiam nor the DNA Testers can guarantee the accuracy or completeness of the analysis provided to you in connection with the DNA Test Service. The analysis does not claim to be conclusive evidence of your DNA or any patterns identified. You should not rely on the analysis, make any decisions, take or not take any action based on them and iamYiam strongly recommends that you seek advice from a qualified healthcare professional if you have any specific queries or concerns relating to the analysis or any medical matter. Any actions or decisions that you take are entirely at your own risk.

    6. By supplying the biological sample(s) necessary for the DNA Test Service, you confirm that you are authorised to supply the biological sample(s) to iamYiam for testing under the DNA Testing Service, and to receive the results of the biological sample(s).

    7. If the biological sample(s) you provide is insufficient in quantity or quality you may be required to resubmit a fresh biological sample.

    8. Prior to purchasing the DNA Test Service and submitting any biological sample(s), you should ensure you have thought carefully about the consequences of knowing more information about your genes as a result of using the DNA Test Service and are ready to receive the analysis. Whilst the analysis you will receive is a lifestyle biomarker analysis it may provide information which you were not anticipating or find distressing.

  2. Orders and Contracts

    1. You can order the DNA Test Service through the Platform.

    2. You may also choose to book a concierge or genetic counselling session with one of our in-house practitioners to help you on-board to the Platform;

    3. We will provide any Services purchased by you in a way that conforms to their description on the Platform and these User Terms.

    4. When you submit an order on the Platform for Services, iamYiam will send you an email to confirm that your order is accepted, payment has been received and that you have entered into a contract with iamYiam, which incorporates these User Terms ("Contract").

    5. You must keep your contact details in your Account up-to-date so that iamYiam is able to contact you about your order.

    6. Once you have entered into the Contract, we will deliver the DNA test kit to the delivery address provided. When you receive the DNA test kit, please follow the instructions provided, or contact us if you have any questions.

    7. If you are located in the UK, you will receive a pre-paid envelope or labelled return box in which to return your completed DNA sample. If you are located outside the UK, you will need to arrange, and pay, for return of your DNA sample unless a pre-paid envelope or labelled return box has been provided by one of our DNA Test Service providers.

    8. Any delivery times given on the Platform or in connection with the DNA Test Service are estimates only and cannot be guaranteed.

  3. Cancellation of orders

    1. The following Clauses do not affect your rights of cancellation which exist under any local mandatory laws which apply in the country in which the Contract between you and iamYiam was formed.

    2. To exercise your right of cancellation for the DNA Test Services or any other Service, contact us here . In your message, copy and fill out the Cancellation Notice provided at the end of these User Terms. If you use this option, iamYiam will acknowledge receipt of your cancellation notice without delay. Your notice must reach iamYiam before the cancellation period expires.

    3. iamYiam will make any refunds using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you.

    4. If you are a consumer (i.e. not buying the Services in the course of your business, trade or profession), then the following cancellation procedures apply.

DNA Test Services

    1. If you have purchased the DNA Test Services, you may cancel your Contract for these Services without giving any reason by informing us in accordance with Clause 11.2 that you wish to cancel at any time within 14 days of the Contract being formed between you and us (the “Cancellation Period ”), and:

      1. if you cancel your Contract for DNA Test Services during the Cancellation Period where you have not opened the DNA test kit, and you return the DNA test kit in accordance with Clause 11.8 below within 14 days of notifying us of your cancellation, we will refund you for all payments that we have received from you in relation to your Contract, including any delivery charges for us sending the DNA test kit to you. You will be responsible for the cost of returning the DNA test kit to us; or

      2. if you cancel your Contract for DNA Test Services during the Cancellation Period where you have either opened the DNA test kit, or you do not return the DNA test kit in accordance with Clause 11.8 below within 14 days of your cancellation, the cost of the DNA test kit will be deducted from any refund provided to you. For health and safety reasons we cannot accept returns of any DNA test kits that have been opened.

    2. If you return a completed DNA test kit linked to a registered Account to us, this will be deemed instructions for us to start performing the DNA Test Services, as we start providing the DNA Test Services as soon as we receive your sample. If you return a completed DNA test kit to us which is not registered to an Account within 30 days it will be destroyed and you will need to order a new DNA test kit.

    3. If you instruct us to start performing the DNA Test Services before the end of the Cancellation Period, then you agree that you will lose your right to cancel any proportion of thee Services that have been performed. If you cancel during the Cancellation Period, but after we have started the Services, you must pay us for the Services provided up until the time you cancel (together with the cost of the DNA test kit). We will refund you the cost of the proportion of the Services that have not been performed.

    4. If you wish to cancel, please return any unopened DNA test kits (including all packaging, any accessories and free gifts which came with them) to iamYiam at C43, 5 New Union Square, Ambassador Building - Embassy Gardens, SW11 7BQ, London, UK without undue delay and in any event within 14 days from the day on which you notified iamYiam of your cancellation.

    5. iamYiam will refund the relevant amount without undue delay and, where the DNA test kit has been purchased in the UK, no later than 14 days after the earlier of:

      1. the day on which iamYiam receives the unopened DNA test kit; and

      2. the day you provide evidence that you have returned the unopened DNA test kit to iamYiam.

    6. If you are unable to return the DNA test kit (or you have opened the DNA testing kit), we will refund the relevant amount no later than 14 days after the day iamYiam receives your notice to cancel your Contract, subject to the deduction of the cost of the DNA test kit and any Services provided.

Other Services

    1. If you have purchased Services which do not include the DNA Test Services, you may cancel your Contract for those Services without giving any reason by informing iamYiam in accordance with Clause Error: Reference source not found below that you wish to cancel at any time within 14 days of the Contract being formed between you and us (the “ Cancellation Period”).

    2. If you instruct us to start performing any Services ordered before the end of the Cancellation Period, then you agree that you will lose your right to cancel any proportion of the Services that have been performed. If you cancel during the Cancellation Period, but after we have started the Services, you must pay us for the Services provided up until the time you cancel. We will refund your pre-payment made for the proportion of the Services that have not been performed.

PART 4 Appointments with Practitioners

This Part applies if you use the Platform to book an Appointment with a Practitioner. iamYiam provides the Platform that facilitates the booking of Appointments and is not responsible for the treatments and services purchased from the Practitioners.

  1. iamYiam's role

    1. iamYiam provides the Platform, which is a marketplace in which Practitioners can advertise and take bookings for their treatments and services. The Platform allows you to enter into a contract directly with the Practitioner, under which you will purchase, and the Practitioner will supply, the relevant treatments and services. iamYiam also facilitates the taking of payments from you on behalf of the Practitioners as their agent. The Practitioners will then provide their treatments and services directly to you. iamYiam is not responsible for the treatments and services purchased from Practitioners after you have made an Appointment.

    2. iamYiam provides you with a range of Practitioners with whom you can choose to make Appointments. iamYiam does carry out its own checks on Practitioners before making their treatments and services available on the Platform, but in doing so iamYiam does not endorse or recommend those Practitioners or make any representation about their suitability, safety or quality.

    3. iamYiam does not monitor, and is not responsible for, the accuracy or completeness of the description of the Practitioner's services, fees or for any other information about the Practitioner that is communicated via the Platform. If you have any questions, please contact us at the contact details set out in Part 1 above and iamYiam will assist by liaising with the Practitioner to try to respond to your questions.

    4. You must ensure that you make the Practitioner aware of any conditions, symptoms, illnesses or other information relating to your health or physical or mental state that might be relevant to any and all treatments and services you purchase.

  2. Booking Appointments

    1. After you have submitted an enquiry about an Appointment and provided your payment details, iamYiam will accept your enquiry, and take payment. The checkout page on the Platform incorporates these User Terms and forms a legally binding contract between you and the Practitioner (iamYiam acts on behalf of the Practitioner, as its agent, to facilitate entering into the contract).

    2. Our practitioners aim to respond within 24 hours to confirm whether the Appointment and time(s) you have requested are available. If the practitioner does not respond within 24 hours, iamYiam will cancel your enquiry, refund your payment and provide you with a link to search for alternative practitioners.

  3. Cancellations

    1. Subject to Clauses 14.2, 14.3 and 14.4, dependent on the type of services for which you are booking an Appointment, you may have a legal right to change your mind and cancel your booking for an Appointment within 14 days of placing the booking. If you wish to cancel, or make a change to, an Appointment after you have received an Appointment Confirmation, please contact iamYiam through the Platform or at contact us here .

    2. You will not have a legal right to cancel Appointments that are considered leisure activities or are related to leisure activities (for example yoga, pilates, tai chi, qigong and meditation) (“Leisure Activities”), but for these services we may at our discretion allow you to cancel at any time until 48 hours before the scheduled start time of the Appointment with no charge.

    3. For all Appointments, we start preparing and providing our services in relation to such Appointment, including confirming with the relevant Practitioner, 48 hours prior to the scheduled start time of the Appointment (“ Start Time”). Where you book an Appointment less than 14 days in advance of the Start Time, you agree that you will lose any statutory right to cancel (if applicable) once our services and the Appointment has been completed.

    4. If you cancel an Appointment at any time from the Start Time until 24 hours before the commencement of the Appointment, you will be charged 50% of the fee for your Appointment. If you cancel less than 24 hours before the commencement of the Appointment, you will be charged 75% of the fee for your Appointment.

PART 5 Ordering of Supplements

This Part applies if you use the Platform to order a Supplement. iamYiam provides the Platform that facilitates the purchasing of Supplements and is not responsible for the provision of Supplements.

  1. iamYiam's role

    1. iamYiam provides the Platform, which is a marketplace in which Supplement Providers can advertise and take orders for their products. iamYiam takes payment from you on behalf of the Supplement Providers as their agent. The Platform allows you to enter into a contract directly with the Supplement Provider, under which you will purchase, and the Supplement Provider will supply, the relevant Supplements. iamYiam also facilitates the taking of payments from you on behalf of the Supplement Provider as their agent. The Supplement Providers will then provide their products directly to you. iamYiam is not responsible for the products you receive from Supplement Providers after you have made an order.

    2. iamYiam provides you with a range of Supplements from which you can select to place an order. iamYiam does carry out its own checks on Supplement Providers before making their products available on the Platform, but in doing so iamYiam does not endorse or recommend those Supplement Providers or their products or make any representation about their suitability, safety or quality.

    3. iamYiam does not monitor, and is not responsible for, the accuracy or completeness of the description of the Supplements, Supplement Provider’s fees, or for any other information about the Supplements that is communicated via the Platform. The pictures that are provided are representative only and not meant to be an accurate depiction of the Supplement in question. If you have any questions, please contact us at the contact details set out in Part 1 above and iamYiam will assist by liaising with the Supplement Provider to try to respond to your question.

    4. You must ensure that you make any enquiries needed of the Supplement Provider regarding any conditions, symptoms, illnesses or other information relating to your health or physical or mental state that might be relevant to any Supplements you purchase.

  2. Ordering Supplements

    1. After you have submitted an order for a Supplement and your payment details, iamYiam will process and acknowledge your order (“Order Acknowledgement”) and take payment using the details you provided and we will aim to confirm the items have been despatched within 24 hours of the Order Acknowledgement (“ Order Confirmation”).

    2. If the supplement(s) you have requested are not available, iamYiam will not send out an Order Confirmation and will inform you of this and issue a full refund for the corresponding products. iamYiam may suggest other Supplement Providers who could provide a similar supplement, but this is not an endorsement or recommendation of the suggested Supplement Provider.

    3. The Order Confirmation incorporates these User Terms and forms a legally binding contract between you and the Supplement Provider (iamYiam act on behalf of the Supplement Provider, as its agent, to facilitate entering into the contract).

  3. Cancellations AND RETURNS

    1. If you wish to cancel, or make a change to, an Order after you have received an Order Confirmation, please contact us here. We will let you know if your requested change is possible. If it is possible we will let you know about any changes to the price of the Supplement, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.

    2. There is no charge for cancellations made before the Order Confirmation has been sent and you will be refunded in full.

    3. After the Order Confirmation and for most Supplements, you have a legal right to change your mind within 14 days of receiving the Supplement (the “ Cancellation Period”) and receive a full refund. This right does not apply to any products sealed for health protection or hygiene purposes, if they have been unsealed.

    4. If you wish to return any Supplement please contact us here within the Cancellation Period and you will be sent a return label to allow you to send the Supplements back to us.

    5. If you cancel your order prior to the Order Confirmation or during the Cancellation Period and you have not opened the Supplements, iamYiam will refund you for all payments that iamYiam has received from you in relation to the Supplements you are returning (i.e. the price you paid for the Supplements together with the relevant delivery costs). iamYiam will refund you using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise by the method. We may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop. Your refund will be made within 14 days from the day on which we receive the unopened Supplements back from you.

    6. You are responsible for the costs of return in all circumstances unless:

      1. the product is faulty or misdescribed; or

      2. you are ending the contract because we have told you of an upcoming change to the Supplement or these User Terms, an error in pricing or description, a delay in delivery due to events outside our control or because you have a legal right to do so as a result of something we have done wrong.

PART 6 Your Content

  1. UPLOADING CONTENT

    1. Whenever you make use of a feature that allows you to upload content to our Platform, or to make contact with other users of our Platform, you must comply with the content standards set out in our Acceptable Use Policy.

    2. You confirm that your contribution complies with those standards, and you will be liable to us and compensate us for any loss or damage we suffer as a result of any content you upload to the Platform that does not comply.

    3. Any content you upload to our Platform will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of our Platform a limited licence to use, store and copy that content and to distribute and make it available to third parties.

    4. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our Platform constitutes a violation of their intellectual property rights, or of their right to privacy.

    5. We do not actively monitor the content on the Platform, but we have the right to remove any posting you make on our Platform if, in our opinion, your content does not comply with the standards set out in our Acceptable Use Policy.

    6. You are solely responsible for securing and backing up your content.

PART 7 Searching and Suggestions

  1. Searching and Suggestions

    1. Any search conducted by iamYiam cannot be comprehensive or cover all known issues, factors, science, conditions and situations. Searches are limited to research and knowledge deemed relevant by iamYiam for common wellness and lifestyle goals and to the Practitioner and Supplement details which appear on the Platform.

    2. You are responsible for ensuring that the information you provide to iamYiam for any searches is accurate and relevant to your search.

    3. iamYiam does not provide medical advice or endorse, promise or guarantee the effectiveness of any specific course of action, resources, tests, Practitioners, Supplements, therapies, drugs, biologics, or other products, procedures, opinions or other information that may be returned by a search on our Platform, mentioned on our Platform or available through our Services.

PART 8 Payment

  1. Payments

    1. All prices set out in the Platform are stated inclusive of all taxes payable in the United Kingdom. You are responsible for assessing and paying any taxes which arise under local law outside the United Kingdom.

    2. You may pay for the Services:

      1. using your credit or debit card;

      2. using such e-wallets or e-money as are accepted on the Platform from time to time; or

      3. using credits from your digital iamYiam wallet.

    3. You must enter your chosen payment method and details when you submit your order. By completing your payment details, you confirm that the method of payment being used belongs to you.

    4. Your credit or debit card account will be debited with the cost of the Services and any postage and packaging costs as set out above after you submit your order.

    5. All payments are subject to the approval of the financial institution issuing your credit or debit card and credit verification or the provider of e-money or an e-wallet, and iamYiam will not be responsible if the payment fails credit verification or if such financial institution or provider refuses to accept or honour the payment for any reason. iamYiam may also report any suspicious transactions to the relevant authorities without notice to you. iamYiam may reject any order without giving any reason. Please note that it can take 2 to 3 working days (excluding weekends and bank holidays) to process your payment. iamYiam will tell you if we incur any issues obtaining approval for the payment. This may cause a delay in delivering the Services to you and we will not be able to accept your order and deliver the Services, Appointment Confirmation or Order Confirmation (as applicable) until we have received authorisation.
